PIPEDA COMPLIANCE STATEMENT

We welcome you to www.acubliss.app operated by DynaBliss, Inc. In the below PIPEDA Compliance Statement, we inform you about the scope of the processing of your Personal Information. This PIPEDA Compliance Statement sits in line with our Privacy Policy, is supplemental and applies to all Canadian Citizens that are using our platform and the AcuBliss platform (the “Services”). As such DynaBliss proceeds with all data processing procedures (e.g., collection, processing, and transmission) in accordance with the Personal Information Protection and Electronic Documents Act (“PIPEDA”). Nothing in this Statement is intended to contradict or limit the applicability of the information provided in our Privacy Policy.

The following provides you with an overview of the type of data collected and how it is used and passed on, the security measures we take to protect your data and how you can exercise your rights.

Personal Information is information that makes it possible to identify a natural person. This includes in particular, your name, date of birth, address, telephone number, e-mail address, but also your IP address. Anonymous data as such only exists if no personal reference to the user can be made.

  1. Information we may collect

    1. We may collect and process the following data which may contain Personal Information:

      1. information that you provide by filling in forms on the acubliss.app platform, including information provided at the time of registering to use our platform, subscribing to any services provided by us, reporting a problem with our platform, or requesting further services;

      2. information, data, documents or images that you upload onto our platform;

      3. details of transactions you carry out through our platform;

      4. details of your visits to our platform, resources that you access;

      5. if you contact us, a record of that correspondence; and

      6. responses to surveys that we send to you, although you do not have to respond to them.

  2. IP Addresses

    1. We may also collect and process information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our business partners. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.

  4. Where we store your data

    1. The Personal Information that we collect may be transferred to, and stored at, a destination outside Canada in the USA using Amazon Web Services by Amazon.com, Inc. It may also be processed by staff operating outside Canada who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the fulfillment of your services ordered by you, the processing of your payment details and the provision of support services. For further information in accordance with Principle 4.1.3 and 4.7 of PIPEDA, please refer to our Data Processing Addendum.

    2. By submitting any Personal Information to us, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your Personal Information is treated securely and in accordance with this Statement.

    3. All information you provide to us is stored on our secure servers. Where you have chosen a password which enables you to access certain parts of our platform, you are responsible for keeping this password confidential. We ask you not to share the password with anyone.

    4. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our platform; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

  5. Uses made of the information

    1. We use information held, including Personal Information, in the following manner:

      1. to ensure that content from our platform is presented in the most effective manner for you and for your computer;

      2. to provide you with information, services that you request from us, and to otherwise carry out our obligations arising from any contracts entered into between you and us;

      3. to provide you with information, services which we feel may interest you, where you have consented to be contacted for such purposes;

      4. to allow you to participate in interactive features of our service, when you choose to do so;

      5. to notify you about changes to our services;

      6. to investigate any complaints relating to the use of our platform or any suspected unlawful activities;

      7. complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;

      8. any other purposes for which you have provided the information; and

      9. carrying out whatever else is reasonable or related to or in connection with the above and our provision of services to you.

  6. Disclosure of your information

    1. We may disclose your Personal Information to third parties:

      1. for the purposes of providing services that you request from us, fulfilling our obligations arising from any contracts entered into between you and us, processing payments in connection therewith or otherwise in connection with your use of our platform;

      2. in the event that we sell or buy any business or assets, in which case we may disclose your Personal Information to the prospective seller or buyer of such business or assets; or

      3. if we or substantially all of our shares or assets are acquired by a third party, in which case Personal Information held by us about our customers will be one of the transferred assets.

    2. We may also disclose your Personal Information to a governmental or regulatory body, law enforcement, or other authorities, in order to enforce our terms of use for the platform, to cooperate with any direction, request or order from such parties or to report any suspected unlawful activity.

  7. Consent

    1. By providing your Personal Information to us, you consent to the collection, use and disclosure of your Data by us for the purposes set out in this Statement.

    2. Where any Personal Information relates to a third party, you represent and warrant that the Personal Information is up-to-date, complete, and accurate and that you have obtained the third party’s prior consent for our collection, use and disclosure of their Personal Information for the Purposes. You agree that you shall promptly provide us with written evidence of such consent upon demand by us.

    3. Each use of our services by you shall constitute a fresh agreement for us to collect, use and disclose the Personal Information in accordance with this Statement.

    4. You may withdraw your consent and request us to stop using and/or disclosing your Personal Information for any or all of the Purposes by submitting your request to us using via email to privacy@dynabliss.com. Should you withdraw your consent to the collection, use or disclosure of your Personal Information, it may impact our ability to proceed with your transactions, agreements, or interactions with us. Prior to you exercising your choice to withdraw your consent, we will inform you of the consequences of the withdrawal of your consent. Please note that your withdrawal of consent will not prevent us from exercising our legal rights (including any remedies) or undertaking any steps as we may be entitled to at law.

  8. Your privacy rights

    1. You have the ability to exercise the following rights:

      1. Right to withdraw consent - You have the right to withdraw your consent at any time, subject to legal and contractual restrictions. Note that your withdrawal of such consent may limit your ability to obtain certain products and services.

      2. Right of access, correction, deactivation or deletion of accounts - You have the right to request access to and obtain a copy of any of your personal information that we may hold, to request correction of any inaccurate information relating to you and to request the deactivation or deletion of your accounts under certain circumstances.

      3. Right to submit a privacy complaint - You have the right to submit a complaint with the Privacy Commissioner in the jurisdiction of your residence if you consider that our management of your personal information infringes applicable laws.

  9. Access and Correction

    1. The PIPEDA gives you the right to access your Personal Information. Your right of access can be exercised in accordance with the PIPEDA. Any access request may be subject to a fee of an administrative fee at our rates then in force to meet our costs in providing you with details of the information we hold about you.

    2. the event that you wish to correct and/or update your Personal Information in our records, you may inform us in writing of the same by using our contact form or via email to privacy@dynabliss.com. In certain cases, Personal Information may also be corrected or updated via the platform.

    3. We will respond to requests regarding access and correction as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any Personal Information or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PIPEDA).

    4. You also have the right to lodge a complaint with a data protection supervisory authority. The Office of the Privacy Commissioner of Canada (OPC) is the relevant authority in matters of data protection. You have the right to make a complaint at any time to the OPC (www.priv.gc.ca/en). We would, however, appreciate the chance to deal with your concerns in the first instance.

  10. Accuracy

    1. We endeavor to ensure that all decisions involving your Personal Information are based upon accurate and timely information. However, we rely on you to disclose all relevant information to us and to inform us of any changes in your Personal Information. As such, please disclose all relevant information necessary for us to provide services to you and ensure all information submitted to us is up-to-date, complete, and accurate. Kindly inform us promptly if there are any changes in your Personal Information.
  11. Retention

    1. We may retain your Personal Information for at least five (5) years, or such other longer or shorter period as may be necessary to fulfill the purpose for which it was collected, or as required or permitted by applicable laws. We will cease to retain your Personal Information or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the Personal Information was collected and is no longer necessary for legal or business purposes.
  12. Third Party Policies

    1. Our platform may, from time to time, contain links to and from the websites of our partner networks, business partners and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any Data to these websites.
  13. Data Intermediary

    1. Where we process your Personal Information as a data intermediary on behalf of a third party, we will process your Personal Information in accordance with the instructions of the third party and shall use it only for the purposes agreed between you and the third party. All such Personal Information will be protected and retained in accordance with this Statement and the terms of the PIPEDA.

    2. We will take steps to inform the third party of any requests, complaints, or questions that you may have regarding such Personal Information.

  14. Data Breaches/Notification

    1. Databases or data sets that include Personal Information may be breached inadvertently or through wrongful intrusion. Upon becoming aware of a data breach, we will notify all affected individuals whose Personal Information may have been compromised, and the notice will be accompanied by a description of action being taken to reconcile any damage as a result of the data breach. Notices will be provided as expeditiously as possible after which the breach was discovered.
  15. Children’s Privacy

    1. Our services are restricted to users who are 18 years of age or older. We do not knowingly collect Personal Information from anyone under the age of 18. If you suspect that a user is under the age of 18, please contact us.
  16. Changes

    1. Because we’re always looking for new and innovative ways to improve our platform and services, this policy may change over time. We will notify you before any material changes take effect so that you have time to review the changes.
